Again and again there is a conflict between the national and European courts as to who should be entitled to the (sole or primary) protection of Union (fundamental) rights. In the opinion of some national courts, the European Court of Justice often overshoots the bounds of the justifiable level of European protection of fundamental rights. Critical voices in this regard traditionally come primarily from Germany in the form of the BVerfG, but the courts of other MS also criticise directly or indirectly. But is there really a sole guardian?
