EuGH, 22.11.2022 - C-37/20, C-601/20: Geldwäsche: Teilweise Rechtswidrigkeit der EU-Geldwäscherichtlinie (Kommentar Barbist, 2023)
Transparenz ist gut, kann aber auch zu weit gehen. Der EuGH hat kürzlich entschieden, dass der uneingeschränkte Zugang der Öffentlichkeit zum Register der wirtschaftlichen Eigentümer die Grundrechte der betroffenen Personen verletzt. Was dies für die Einsicht in das österreichische Transparenzregister bedeutet, ist unklar. Das Gebot einer richtlinienkonformen Auslegung kollidiert mit dem engen Wortlaut des österreichischen Umsetzungsgesetzes (§ 10 WiEReG). Und eine unmittelbare Wirkung der EU-Geldwäscherichtlinie ist auch nicht einfach zu argumentieren.
